Liens arising subsequent to recording of master deed or lease
- Statute:
- South Carolina §27-31-230 · Chapter HPA (Horizontal Property Act (S.C. Code §§ 27-31-10 to 27-31-440))
- Topic:
- Ownership · Mechanics liens
- Applies to:
- Condo associations
After the master deed is recorded, liens attach to individual apartments and their percentages, not the whole property. A contractor hired by one owner cannot lien a neighbor's apartment except for emergency repairs. Authorized common-element work is treated as done with every owner's consent and may lien each apartment; an owner can clear that owner's apartment by paying the fractional share.
