Georgia Condo, Co-op & HOA Law — A Plain-English Reference for Board Members
121 sections of Georgia community-association law, translated into plain English. Georgia splits the two kinds of community. Condos live under the Georgia Condominium Act (O.C.G.A. §§ 44-3-70 to 44-3-117). Subdivision HOAs do not automatically live under a statewide HOA statute — the Property Owners’ Association Act (O.C.G.A. §§ 44-3-220 to 44-3-235) is opt-in. The declaration (or a later amendment) has to say so. The Georgia Nonprofit Corporation Code fills in the corporate gaps — directors, member meetings, records — but only where it does not conflict with the association statute. The Property Owners’ Bill of Rights (SB 406, new Title 43 Ch. 17A) is already law; most of it, including SOS registration, does not take effect until 1 January 2027.
