Alabama Condo, Co-op & HOA Law — A Plain-English Reference for Board Members

127 sections of Alabama community-association law, translated into plain English. Alabama splits the two kinds of community, then keeps the corporate body underneath. Condos created after January 1, 1991 live under the Uniform Condominium Act of 1991 (Ala. Code §§ 35-8A-101 to 35-8A-417). Older condos stay under the Condominium Ownership Act (Chapter 8), with a listed set of 8A sections — including the assessment lien and association records — also reaching them. Subdivision HOAs whose declaration is recorded on or after January 1, 2016 (or older ones that elect in) live under the Homeowners’ Association Act (Chapter 20): they must organize as a nonprofit corporation and file governing documents with the Secretary of State.
