This chapter applies to developments whose declaration providing for an HOA is recorded on or after January 1, 2016, and to an older association that elects in by a majority of its members. It does not apply to commercial or other nonresidential developments, any association regulated under Chapter 8 or 8A (condos), or a real-estate cooperative, time-share, or campground. An older residential HOA that has not opted in runs on its recorded declaration and general corporate law.
