This chapter applies to every Alabama condominium created after January 1, 1991. A listed set of sections — including variation (§104), titles and tax (§105), local ordinances (§106), eminent domain (§107), declaration validity (§203), unit description (§204), listed association powers, tort/contract liability (§311), the assessment lien (§316), records (§318), resales (§409), and substantial completion (§417) — also applies to older condos created before that date, only as to later events and without invalidating existing instruments. Chapter 8 does not apply to post-1991 condos unless the declaration of a four-or-fewer-unit condo so provides.
