Subject to the declaration, the association — even if unincorporated — may adopt budgets, assess, hire managers, sue, regulate common elements, and after notice and a chance to be heard levy reasonable fines. No late charge if the assessment is paid within 10 days of the due date, and no late charge may exceed 30 percent of the monthly assessment. The association must send written or electronic notice of the amount, the due date, and that 10-day window.
