This Act applies to all homeowner associations created and existing in New Mexico. Sections 47-16-9, 47-16-10, and 47-16-14 do not apply to associations created before July 1, 2013 that have fewer than 30 lots, though any amendment to those communities' documents must still comply with this Act. This Act does not apply to a condominium governed by the Condominium Act.
