Unless the declaration says otherwise, the association may adopt budgets (including reserves), collect assessments, hire managers, sue, and regulate the common elements. Late fees may not exceed the greater of $20 per month or 10 percent of any unpaid installment. After notice and a hearing, the association may suspend privileges (not access to the unit) for assessments 30 days past due and levy fines not to exceed $100 (§3-107.1). Several of these powers also apply to pre-1986 condos.
