A member may not be expelled or suspended except pursuant to a procedure that is fair and reasonable and is carried out in good faith. A procedure is fair and reasonable if it gives at least 15 days' prior written notice of the reasons and an opportunity to be heard at least five days before the effective date, or if it is fair considering all of the facts. Association fine-and-suspension hearings under §47C-3-107.1 / §47F-3-107.1 are the overlay; they cannot cut off access to the unit or lot.
