Damaged insured property must be repaired promptly unless repair is illegal or 80 percent of the co-owners (including the owner of an apartment that would not be rebuilt) vote not to rebuild — bylaws may require more than 80 percent, not less. Excess cost is a common expense. If the whole property is not rebuilt, proceeds are distributed as this section specifies and allocated interests are amended. Applies to every regime notwithstanding a contrary master-deed provision (2006 Act 250).
