Every association must adopt written policies on collections, conflicts, meetings, covenant enforcement and the fine schedule, records inspection, reserve investment, how policies are adopted, owner disputes, and reserve studies. For ordinary covenant violations: certified-mail notice, a 30-day cure, a second consecutive 30-day cure, and a $500 cap on fines for that violation. Safety/health violations: 72-hour cure, then fines every other day. Fines are never a basis for foreclosure. Collections require owner contact first and an 18-month payment-plan offer under §316.3.
