An incorporated association has a statutory lien on a unit for assessments. Fines, fees, late charges, and attorney fees may be part of a lien but may not be the basis of a foreclosure under this article. No legal action on unpaid monthly installments until the owner has missed at least three. The lien is prior to most other liens except taxes and a first mortgage, with a six-month limited super-priority for budgeted assessments. The lien extinguishes in six years if not enforced. A payoff statement is due 14 calendar days after written request; if the association does not furnish it, it cannot assert a lien for assessments due as of the request date. At least 30 days before filing a foreclosure, written and electronic notice (and a mediation offer) is required.
