The board exercises every association power the law or the instruments do not reserve to the owners: operate and repair the common elements, adopt a budget and levy assessments, hire a manager, adopt rules, and after notice and an opportunity to be heard, levy reasonable fines. Spending caps in the instruments do not block repair or replacement of existing common elements. A non-emergency improvement over 5 percent of the annual budget can be stopped if owners with 20 percent of the votes petition within 21 days and a majority of all votes reject it.
