Once there is any non-developer owner, the instruments are amended by an affirmative vote of two-thirds of those voting, or the majority the instruments specify — but the instruments may never require more than a three-quarters vote of all owners. A mortgagee who is asked to consent is deemed to have consented unless it sends a written no within 60 days.
