Neither the association nor any unit owner except the declarant is liable for that declarant's torts on portions the declarant must maintain. Sue the association, not individual unit owners, for association wrongs. If the wrong occurred during declarant control and the association gives the declarant notice and a chance to defend, the then-controlling declarant indemnifies for uninsured judgments and litigation expenses including reasonable attorney fees.
