Before offering any interest in a unit to the public, a declarant prepares a disclosure statement. Responsibility may be transferred to a successor declarant or a dealer; the person who prepared a portion is liable for false or misleading statements and material omissions in that portion. A declarant who delivers a statement someone else prepared is liable only with actual knowledge or if reasonable care would have uncovered the statement or omission.
