No amendment of the declaration, bylaws, or operating agreement is valid until it is set out in an amendment and recorded. It is effective on recordation unless it states a later date. A 501(c)(3) owner already leasing when a leasing ban is adopted may keep leasing that unit until a voluntary sale, with no extra fine for doing so. A mortgagee asked to consent is deemed to have consented unless it sends a written no within 60 days.
