Effective 1 January 2027, after a §43-17A-3 order the SOS must send a notice of opportunity for hearing. The association has 10 days after receipt to request a hearing, which is then set within 30 days (but not earlier than five). Unless the association prevails, it pays a $100 administrative service fee. Emergency orders that find public health, safety, or welfare requires immediate action may take effect pending a prompt hearing.
